NSCZ Declares Kamanga’s Term Ends on February 28th, 2025

NSCZ Issues Strong Directive to FAZ Over Election Irregularities

The National Sports Council of Zambia (NSCZ) has issued a stern directive to the Football Association of Zambia (FAZ), warning that failure to comply with legal advice from the Attorney General could lead to suspension. This follows the controversial disqualification of presidential candidates and concerns over constitutional irregularities in the upcoming FAZ elections.

Kamanga’s Term Ends on February 28, 2025

NSCZ has made it clear that it will not recognize Andrew Kamanga as FAZ president beyond February 28, 2025. Kamanga, who was re-elected in 2021, was set to serve a four-year term, which expires on this date. However, the FAZ Electoral Committee scheduled the elective Annual General Meeting (AGM) for March 29, 2025, a decision the NSCZ deems unconstitutional.

NSCZ CEO Sombwa Munsansa emphasized during a press conference in Lusaka that the FAZ Constitution must be followed to ensure a smooth transition of leadership. He stated:

Holding elections after the expiration of the current term, such as the proposed 29th March 2025, will be inconsistent with the provisions of the Constitution. Accordingly, the Attorney General has guided that the mandate of the president and the executive committee will lapse on 28th February 2025.”

With eight presidential candidates disqualified, Kamanga currently remains unopposed. However, disqualified candidates have until February 22, 2025, to appeal.

Constitutional Irregularities and Candidate Disqualifications

Apart from the election timeline concerns, the NSCZ also flagged irregularities in FAZ’s governance structure. The key issue raised is the improper inclusion of the Governance and Review Committee and the Audit and Compliance Committee in both the FAZ Standing Committees and Judicial Bodies.

Sombwa explained:

“The FAZ Constitution prohibits members of judicial bodies from serving on Standing Committees, ensuring a clear distinction between these bodies to maintain their independence and prevent conflicts of interest.”

This means that FAZ must restructure these committees in compliance with Article 41 of its Constitution.

NSCZ’s Directives to FAZ

To rectify the situation, the NSCZ has issued several directives, urging FAZ to:

  1. Revisit the vetting process of candidates for the elections and appoint a credible committee to oversee nominations.
  2. Amend the FAZ Constitution to align with the Attorney General’s advice and the Sports Council of Zambia Act.
  3. Provide full transparency on why candidates were disqualified from the elections.

Failure to comply, the NSCZ warns, could lead to the suspension of FAZ’s activities. Under Chapter 142 of the Laws of Zambia, the NSCZ has the authority to suspend an association if it violates legal guidelines.

What’s Next for FAZ?

With just over a week until February 22, the deadline for appeals from disqualified candidates, FAZ now faces increasing pressure to resolve election disputes and adhere to constitutional requirements.

The coming weeks will be crucial in determining whether FAZ follows NSCZ’s directives or risks serious consequences, including possible suspension.
